David Louis Bentley, 58, of 302 Buchanan Street, Fairbank, Iowa, pled guilty to Indecent Contact with a Child, an Aggravated Misdemeanor, in the Iowa District Court for Fayette County on Wednesday, February 4, 2015. Bentley was sentenced to a suspended prison term of two years and placed on probation supervision to the First Judicial District Department of Correctional Services on the corrections continuum for a period of two years. The corrections continuum permits the Department of Correctional Services to place Bentley into a residential treatment facility if, in the discretion of the Department of Correctional Services, completion of such a program becomes necessary and appropriate based on Bentley’s acts and/or omissions following sentencing. Bentley is also required to register as a sex offender, pay a fine of $625.00, surcharge of $218.75, sex offender registry civil penalty of $250.00, and sex offender registry fee of $25.00. A no contact order was also entered preventing Bentley from having any contact with his victim for five years, after which it may be renewed for additional five year terms. Following successful completion of probation, Bentley will remain under the supervision of the Department of Correctional Services as if on parole for an additional period of ten years.
Bentley was arrested and charged with Indecent Contact with a Child in Buchanan County on May 15, 2014, following an investigation by the Fairbank Police Department and Iowa Department of Human Services of a 2013 incident in which Bentley was accused of touching the clothed breasts and inner thigh of an 11-year old minor who had previously received daycare services in Bentley’s home located at 305 6th Street North, Fairbank, Iowa. The case was later moved to Fayette County upon Bentley’s motion to change venue.
